  3. Converting from h1b to F1 then OPT then back to H1b - is it feasible?

    I got my h1b approved and planning to do my Masters and graduate before my h1b expires.
    If this doesn't work then i can do a full time schooling by changing to f1

    1. is it possible to change from h1b to f1
    2. can i apply for OPT again for MS , I am on OPT STEM
    3. can I apply for 17 months OPT extension my 12 months opt expires after Master as I have not used 17 months for my bachelor.

  4. 1. Yes, you will be able to file a COS back to F-1 on Form I-531.
    2. Yes.
    3. Don't think so, no. But ask your school"s DSO and see what he or she says about that.

  5. Employer willing to start GC processing, I do not have H1b, will this cause any issues?

    I was on OPT and my company has started the GC process. I did not get through last years lottery and enrolled school to maintain my status

    Is it okay to apply for PERM process without h1b visa, will there be any issues going forward doing so given my situation/

  6. Green card is for future employment. AN employer can file a GC even though you are not working for them on h-1b

  7. If h1b application be jeopardized if i am unemployed?

    I am working on EAD and waiting for h1b approval. My EAD expired in 2 months after i got paid from employer for the same period.

    I have successful EAD renewal since then. What will be the consequences on my h1b visa or any immigration work issues?

  8. It can affect your adjustment of status. You may wish to leave the U.S. and get a new visa, which may avoid the problem.

  9. Will I be able to get the h1b exemption?

    Company1 filed h1b petition in 2014 and i was picked in the lottery. My application is still in process. If company1 withdraws petition can company2 file petition in the same year as I am under quota?

    Should I have to wait till the next lottery?

    To be exempt, you have to have a previously approved H-1B..not just be picked in the lottery.

  11. Can i apply new h1b if I had appealed h1b with old employer?

    I filed h1b in April and got RFE. My company sent documents but RFE was rejected. Later they tried appealing to USCIS and said it takes time to get back.

    I started searching job elsewhere with non-profit organizations that are h1b cap exempt and looks like I may land a job with them.

    So, will the appeal made by previous employer affect in any way? Should I ask them to withdraw appeal?

  12. Each appeal is filed separately. So it shouldn't affect.

    For time period, it might take around a year to get the response sometimes.

  13. I have H1b from 2 employers and can I transfer from F1 to h1 from October...

    My h1b got approved for employer 1 and found employer 2 just filed new h1b last friday. Now, employer b is pending

    1. should i work for employer 1
    2. should i work for employer 2
    3. should i go to school changing h1b to f1?

  15. H1B application change of status stamping..

    My H1B visa is approved which will be active from 1st Oct 2013. Since it is a change of status application from F1 to H1, is it alright if I go for the stamping before 1st October?
    I am currently out of USA and will be returning on my student Visa (F1) before Oct 1. Is it ok if I get H1B stamped when I am in India?

  16. You will be eligible to go for H1B visa stamping up to 90 days before the start date on H1B I-797 approval date (Oct 1st). You may enter through F1, but in case you delay then you can enter up to 10 days prior to Oct 1st.

  17. Is Writing and publishing allowed on F1 or H1b visa?

    I am studing in a Univesity on F1 and will be applying for H1b in a couple of months.
    I am also a writer -usually writing blogs, novels, short stories etc. I am also planning to get my book published, but not sure whether it violates any visa terms or not.

    Also, can I participate in writing competitions? If I win, will that violate income terms or my visa ?

  18. You earn revenue through book publication and you will not be able to do it with your H1b.
    However, winning a writing competition should not be a problem.

  19. Is it possible to convert h1b to F2?

    I might get my h1b visa terminated soon.My teenager so is on H4. If I enroll my son to a private school, he can change his status to F1, then will I be able to change to F2?

    Will it make me easy to convert to B2 or F2?

  20. B2 is a bad option. You won't be eligible for F2 either as your son is not your spouse.

  21. When h1b is pending, is it possible to process h4?

    After applying h1 and h4 extension I got my reciept number for both applications. I couldn't check the h1B status on USCIS website. I could check h4 status and it showed post decision activity and it was processed in july 2013. Though notice was mailed, I haven't got it yet.
    Does that mean my h4 is approved?

  23. Is it possible to travel to Puerto rico when I h1b is still under process? I have valid OPT btw.

    My opt is valid until November 2014 but it expires in January 2014. H1b processing is still in progress through an employer. I was trying to go for a trip to Puerto Rico. Is that legal?

    I am currently doing my Masters in a US University. I am working for a company on OPT, they want to retain me by sponsoring my H1b.

    Can I still be on F1 as i want to continue studying?

  27. Changing h1b to f1 then back to h1b during 6th year of using h1b..

    My h1b exprires soon as I am on my 6th year of using it. My company is trying to apply for Permanaet labor from Sept 2013 and March 2014 for i-140 approval.
    I am planning to change to F1 for studies and maintaining my status till i-140 gets approved.
    I am then planning to convert back to H1b using the same.

    What chances do I have for getting my F1 visa as my perm labor is still under progress?

    Talk to your company attorney if they can give you some better advice.

  29. I have h1b and want to do PERM for my GC, will i be able to sponsor my husband...

    I have applied to GC and my spouse also did it with me. During the 5+ years waiting time, his h1b expires and he is terminated from the job, will he not be able to stay in US after that? Or can we stay as long as i140 is approved?

  30. He could not extend his H1b based on your PERM. He could file for adjustment with you, once the visa is available, as long as he is in status talking to his employer.that might work better.

    Will this be valid marriage? Are we legally allowed to do this?

  32. Yes, you can . You will be on H-1B and your fiancee will have choice to change status to H-4 or continue to remain on F-1.

  33. Opt extension decision still in initial review..

    Hi i applied for my opt extension on Nov 22 2013. My opt is ending Feb 5th 2014. But it is still showing initial review. Can i continue to work after Feb 5 th till i get the decision. I have been working for the same client since April 2013. How much more time is it going take? Please give some suggestions.

  34. Yes u can work till the decision is pending or 180 days from the end of your initial opt..whichever is earlier....

    You will have to contact your HR and tell your problem..they will ask you to submit the I-765 receipt number (for confirmation that you filed your extension in timely manner).
