    Is it ok to work for 40 hours on h1b and is this mandatory that we need to have a face to face client interaction only?

    Will working on computer not count in this?

    I am starting GC application process through marriage of US citizen. I am right now residing in US on tourist visa.
    1. What should be my status by USCSI to approve my GC if tourist visa will expire?
    2. There is also an employer who is ready to hire me on part time basis which is for language teaching on h1b.

    What is the fastest and cheapest way to start working legally?

  4. This year's (i.e., 2013) h1b cap is complete. you will not be able to get h1b if you or your employer are not cap exempt.

  5. H1b transfer when I am on Cap-GAP with EVC model...

    I am on Cap-Gap. I have already got approval of my H1B starting from Oct 1, 2013. I am in EVC Model. I want to get my H1B transfer. I have already found a new employer & they're ready to transfer my H1B.

    I am trying to change my employer- where in client and vendor are same.

    1. Is it possible that I can ask my new Employer to do initiate H1B transfer during cap gap? If Yes, is it risky? Shall I wait until my H1B starts & then initiate H1B transfer?

    2. If I get H1B transfer done in a month or so (PP) from now, can I start working for new employer right away or I'll have to wait until Oct 1?

  6. You are not subject to the H-1B cap. A new employer can sponsor you for H-1B status, and there is no need to wait until October 1st to start working.

  7. Is college degree needed to apply H1B?

    I have 8 years of experience, but still doing my studies. When I tried to check with attorney, they said I can't apply for h1b without a diploma, but i have a friend who got his h1b without even completing his degree.

    Is this feasible to avail job with more years of experience and few years of study?

  8. You can avail H-1 visa without having a four year degree. However, you will have to show that you have the equivalent of a four year degree via education and experience.

    Ask an education counselor whether your degree is equivalent to US - BS degree.

  9. Will I be able to work for another company as soon as they file my h1b transfer?

    I work for companyA on my h1b. Now companyB is ready for h1b transfer and asking me to start working for companyB as soon as they file my h1b.
    Will I be able to do that?

  10. Well, in most cases yes, you should be able to do it

    If certain conditions are met, then you can begin working for Company B once that employer's H-1B petition has been received by USCIS. Check with Company B's immigration attorney to ensure you meet the requirements for doing so.

    Will it be possible to change name in the passport after my h1b petition approved?

    Will that affect my h1b visa stamping?

  13. Applying h1b visa based on 3 years of bachelor's degree - is it valid?

    I am on H4 visa. In India, I did bachelor of Business Studies which is a 3 year program. I am not sure I can apply for H1B directly or I have to do some course to complete the 4 year bachelor program. Thanks!

  14. If you have a 3 year bachelor's degree, you will likely need to use your degree plus some work experience to show that you have the equivalent of a 4 year bachelor's degree.

    You should be talking to Professional education credentials about what steps you can take, whether you are eligible to apply or not.

  15. Will i be able to change employer when I have RFE during h1b processing?

    Petition request h-1 Valid period on Oct 2013, Uscis records show beneficiary ‘s status expired sep 2012, Because beneficiary status appears to have expired prior to the start date, the record does not establish that the beneficiary is eligible for a change of status.



    Request to submit evidence to show beneficiary is eligible for a change of employer to continue in H-1b Status. A form I-94 (Arrival/Departure Record) showing expiration date on or after Sept 3.

  17. Staying in US after h1b 6 years is expired and converting to F1 and later change back to H1?

    My 6 years tenure on h1b is expired and GC pERM is approved.

    I am working as contractor and my employer has no new projects. I might risk being out of status after September.

    1. Will i be able to remain in US by converting F1 and when new project starts can i change back to H1?
    2. Is 9/30 the H1 extension deadline for me ? If its not filed till 9/30, and I do change to F1, then after gap of 2 months (say in Nov), is it still possible to file (with new PO + maybe approved I-140) for H1 extension, change F1 to H1 and begin working?

    3. Will change to F1 hamper the GC /I-140 process ?

  18. generally, yes but it would be best to sit down and discuss your options with an immigration attorney before your current status expires on a particular date. You should file the I-539 before the expiry date.

    I am on my OPT as an f1 student. I am planning to get my specialty license some time next year for ICU but I only have associate's degree in nursing. Can my current employer sponsor me for H1b?

  21. Will I be able to travel to India after my h1b transfer is approved with previous employer?

    I got my i 140 approved and have got priority date under EB3. My 6 year term with current employer is ending in September.
    However, my new employer was able to transfer h1b and get extension till July.
    At this time, I had to travel out of USA and wasn't sure if my visa stamping will have any problems.

    I am trying to look at some advice on what should I be doing so that I wont have any issues back to US with valid visa stamped in my passport
    My GC is also supposed to be processed by new employer. Please help
