    hi,

    i am on h4 visa and could not able to get h1 visa for this year.

    now i am thinking to do some course in computers and get opt here.

    could you please suggest me what kind of course i should do so i can get opt in us.

    i am having 5 years of experience in software testing.

    i will really appreciate if you can provide me some information.i really dont want to waste time.

    For you to be eligible for an OPT you should be enrolled in a certified School on a full time basis continuously for one full academic year (generally 9 months = one academic year) on a Student Visa(F1).

    Even though you are eligible to study on H4 visa you won't be granted an OPT, hence its necessary for you to apply for a student visa. Also understand that certain online offerings from fly by night institutes are not eligible for OPT. Before you decide on a program be sure to carry out your due diligence.

  3. Am I eligible to study on H4 visa after deferring it to next term ??

    Hi,

    I got I-20s from Pace university and NJIT for fall 2012. But because of my personal reasons I want to defer the same to spring.

    My Question is:

    I will be going to U.S on H4 visa this september 2012.

    Is there any possible way to join the school this spring 2012 on H4 visa itself ??

    Please let me know what can I do ??

    It will be very helpful to me, if some one can answer my question.

  4. Yes, you can defer to Spring 2012. Make sure you update the same with admissions coordinator and international students advisor/ coordinator.

    My son who is completing his B.Tech in 2013 April.Can he come to USA on H4 visa as a dependent if I have H1B visa. His age is 22 years now.Please kindly let me know.I am planing to come to USA in 2013 on H1B visa.

    I completed undergraduation with 3years Degree B.Sc MPC Passed 57.7%with 6 back logs in March 2013. actually i was pass out year 2009, when i was in 3rd year degree. but in this year i got govt job as Police Constable.So, i was absent exams MARCH 2009, i have 4 years service still now. am i eligible to study ms in usa

  8. For study MS your eligible. As far MS is concerned you need to fulfil the educational UG requirements. Thats all. No issues about your backlogs and break in the education.

  9. can my wife study in US while she is on H4 ?

    Hi,

    I am moving to US on h1b. My wife will be joining me and she will be on h4. She has done her BA (Eng) and currently doing MA (Eng). She is in first year as of now. I just want to know what options does she have for studies in USA ? Like which degree she will be eligible for..etc. Please help.

  10. Your wife can study in US on H4 without any problem. But Indian three year degrees are not considered as bachelors degree in most of the US universities for masters. Since she has completed her one year of masters, they might consider her for doing masters in USA. I would suggest her to apply for F1 visa, once she gets admitted to college. On F1 she can do on campus jobs like, teachers assistant, Internships etc. The feeling of earing littlebit money while you study is great. CPT/OPT options are available for F1 students and not H4.

    Go for only accredited, non Profit Universities (if Private - less tuition fee) if not go for public Universities (higher tuition fees) she can do MBA (many majors) MA etc.

  11. I am planning to apply for H4 but my husband holds 90 days of validity...

    My husband holds an H1-B visa and has validity for 90 days and he is yet to apply for his extension.I am planning to apply for an H4 visa. Will there be any problem in applying for the same? How long will it take for the visa to be stamped? Kindly let me know the details.

    I am presuming that you are in india.

    If so , apply immediately while yr husband is still having valid H1. Applying for H4 visa when husband's H1 has officially expired is dicey. Husband applying for H1 extension is NOT same as having H1 visa as far yr applying for H4 is concerned.

    Fresh application should take 2 to 3 weeks for visa appointment to materialise depending on yr consulate.

    I shall strongly advise you to get H4 stamped while husband has valid visa , enter USA as early as possible.

    If i have sponsorship from 2 or more consultants, Can i file H1B with both the consultants. Will it create any problem during visa interview. Please suggest if any issues.

  14. If both are approved, you need to choose 1 and appear for stamping with that petition. 2 employers applying for you wouldn't matter during stamping.

  15. More than1company filing H1B:will it go as 2 petitions in lottery or as 1.

    I Have offers from 2 companies willing to sponsor H1B. Can I go ahead and ask both of them to file H1Bs?

    In that case:

    1.Will mine go into the lottery as 2 separate applications?
    2.Assuming it goes as 2 separate/as one application, then will the companies come to know that I am filing for more than one company?
    I know it is not the most ethical act, but I Am forced to accept multiple offers as I come under the 65000 slots and am really scared if I will make it to the US or not. I am an Indian citizen with a masters degree from Singapore and it is with great difficulty I got the two offers.

    Kindly answer my question.

    2. No. They can't know.

    U must choose one and go for stamping if both picked in lottery and approved.

  17. Pick 1 of 2 approvd petitions 4 stmping, what status reported 2 othr emplyr?

    I am in a similar situation wherein I might end up with more than 1 company filing for an H1B on my behalf. I am looking to assure my chances of working in the US because my fiancee is there and hence, I would ask both employers to file for H1B on my behalf (without each being aware of the other ofcourse).

    If both petitions make it through the lottery, LCA, etc, I would be faced with the task of choosing 1 petition to get stamped and the other to be rejected.

    My question is regarding the status that would be reported to the employer who's petition I rejected. Would it be discernable that the candidate withdrew ? How different would it be from the Visa Officer rejecting an applicant ?

    Any idea as to how this would play out ?

  18. Finally its all upto the candidates and the employers. I never recommend someone to go thru multiple petitions.

    1. With current scenario, you are reducing the chances of getting picked in lottery for the other candidates. USCIS expects 150,000 petitions this year as against 127000 or something last year. So the % of getting picked in the lottery is less not just for you BUT for others as well.

    2. If both the petitions gets rejected - you will have no choice except to join your spouse(after marriage) in a dependent visa.

    3. If both are approved, you have to convince the VO if at all the question comes to you.



    Remember both the petitions are still valid if approved. Its just whom you choose to go for stamping and then work.

    Usually a VO doesn't reject the stamping just because you have multiple petitions. Its all upto the VO.

  19. What happens when some of H1b applications are rejected creating vacancies?

    I have couple of questions:
    1. Assume this year we have a lottery. What happens when USCIS rejects some applications and there are some vacant seats? Does this go for lottery again from the previous pool or there is new submission process?

    2. I am already working on L1-B visa and applying this year for H1. My attorney asked me for my recent salary slip. But unfortunately my salary slips are available till last Nov and before, whichI have already provided. Does any one know if this could coz any trouble with my application.
    I will be providing the latest salary slip by end of this month anyways.It all happened some failure at the end of my payroll department>:(

  20. 1) The left over slots will be filled with the wait-listed petitions selected by USCIS during the lottery process

    2) It 'might' result in a RFE, you may respond with your latest then.

  21. what I have to do without job and client letter ?

    My application has been picked up in lottery for premium processing from california. I am waiting for result.But I have lost a job. When I applied for H1B without client letter,bt I have provided just client name and location. So, what I have to do if in case I get a RFE??Waiting for positive response!!!

  22. You lost the job w/ the employer who filed your H-1? In that case, the employer may no longer be ready to support your petition. They may either withdraw it or not respond to any RFE.

  23. When the receipts for H1B regular processing are expected?

    If the petition is selected through lottary, would my employer have received response on the same? Or I will need to wait till USCIS mails the confirmation???

    Will I get receipt number directly or there will be response for lottary selection??

  24. There will be no response for lottery. Your employer/attorney will be notified if receipted. If rejected by lottery, packet will be returned with the fees - which you may not know till mid-may.

  25. What are the realistic chances of an H1B lottery this year (FY 2014)?

    As most of us know, according to a USCIS press release from March 15, 2013, there is a good chance of an H1B lottery this year, which will occur if more than 65,000 applications are recieved between April 1 and April 5, 2013.

    Do you believe that to be true? What do you think the realistic chances of that happening are? Speculations have so far suggested the cap would be met much earlier than last year, though perhaps not as early as in the first 5 days. What do you really think?

    I am hearing all sorts of rumors, so I just want to gauge what people think.

    The lottery sucks, especially for highly educated candidates (PhD), who would have to leave the country if they are not selected.

  26. I wasn't anticipating an early lottery this year, but USCIS's comments have made me rethink.

    Even if the lottery happens, you will get 2 chances (I assume you will be filing under Advanced degree cap). You will first be subject to 20K random selection (if that cap is reached in 5 days), and if not selected in that selection, you will be placed w/ non-advanced degree folks and subject to another selection.

    In other words, your chances are better than those who haven't done education in US.

    I can see many questions on H1B visa cap limit and the lottery system, my question is will this lottery system will include the Premium processing petition cases as well or its only with the normal processing cases?

  30. I am also waiting for response for lottery results. I heard those will be out for regular processing in May.

    They should know about the selected petitions in next 2-3 weeks. After that, they should start receiving the packages that didn't make through the lottery.

    Hi, is there any timeframe within which we will come to know of the all lottery results. When i m checking with the Employer, they only ends with a statement the Petition is filled no one is informaing for how long i need to wait to know ther results. Please help

  32. IMO, selected petitions will know about their selection by mid-May. After that, others will know about their non-selection. Everyone should know about their result by end of June.

  33. My status if not selected for H1B 2014 lottery? OPT Ext Expires on 10/3/13

    I'm a Master's student in OPT Ext working fulltime. What will be my situation if I don't get selected in the lottery process? My OPT expires on Oct 3rd, 2013. Is there any options to continue working and to stay here in US?. If so, how long can I stay/work here?. I would like to know my options and I appreciate your replies & suggestions. Thanks in advance!!.

  34. If you are on regular OPT you can go for a STEM OPT if your company is enrolled in e-verify. Other options are going back to school in the fall of 2013 for which you would have to leave your job few months early to resume studies.

    If your company is not enrolled for e-verify, request them to do it now. It is free. Then you will be eligible for STEM Extension of OPT for another 17 Months, if applicable to your area of specialization. Pls note that even if you enroll for another course of study after expiry of your OPT, you will not get EAD for OPT again for the new course. It is available only once for all the Degrees that you earn.
